1. The service

FotoPobyt lets you upload, capture, crop, preview, export, save, and share document-style photos. A free preview may be available before a paid JPG export.

The App is not affiliated with or endorsed by any government agency. We do not guarantee that a generated photo will satisfy every MOS, residence permit, visa, passport, or other institutional requirement. You are responsible for checking current requirements.

2. Eligibility

You may use the App if you can legally accept these Terms. A minor may use it only with permission from a parent or legal guardian.

3. Your photos

You keep ownership of uploaded photos and outputs generated for you, subject to law and third-party rights. You grant us a limited, non-exclusive, royalty-free license to host, transmit, process, modify, and display them only to provide, secure, and support the App.

You represent that you have the rights and permissions needed to upload each photo.

4. Prohibited use

• uploading photos without the necessary rights or consent;
• impersonating someone or creating misleading identity documents;
• creating or submitting fraudulent, unlawful, or harmful images;
• violating law, third-party rights, or platform policies;
• reverse engineering, disrupting, overloading, or bypassing App security;
• accessing another user’s accounts, jobs, images, or purchases;
• using the App for biometric identification, surveillance, or unauthorized face recognition.

5. Photo requirements

The App may help with a light background, neutral expression, direct gaze, straight head position, and a 684 × 883 export. Requirements can change and vary by institution. The receiving authority makes the final acceptance decision.

6. AI output

AI output may contain artifacts, inaccurate adjustments, or unexpected changes. Carefully review every preview and final file. We may refuse or limit processing that violates these Terms, law, provider policies, or safety requirements.

7. Credits, purchases, and billing

FotoPobyt may sell consumable credit packs. One credit is normally used for a final export; previews may be free. Available packages, prices, and contents are shown before purchase.

Credits are linked to your App user identifier and may require an internet connection plus confirmation by the store, RevenueCat, and our backend. FotoPobyt currently does not offer an auto-renewing subscription.

Apple App Store or Google Play processes payments. Prices and taxes may vary by country, currency, and platform. Refund requests are handled by the store under its rules. Contact us if a successful purchase was not delivered.

8. Restores, devices, and history

Restore availability depends on the store, product type, and RevenueCat configuration. Consumable credits may not restore in the same way as subscriptions or non-consumables.

Deleting the App, changing devices, clearing data, or using another store account may affect credits and history where account linking or restore is unavailable.

9. Third-party services

The App relies on Apple, Google, Firebase, Google Cloud, AWS, OpenAI, and RevenueCat. Their own terms may apply. We are not responsible for outages, delays, store decisions, refunds, AI provider errors, or network issues outside our reasonable control.

10. Intellectual property

The App’s software, design, text, branding, and workflows belong to us or our licensors and are protected by law. These Terms do not transfer ownership of the App or its intellectual property.

11. Availability and changes

We may change, suspend, or discontinue features, prices, credit packs, supported countries, or backend services, subject to applicable law and store rules. Some functions may require the current App version.

12. Suspension and termination

We may suspend access if we believe you violated these Terms, law, or service security. You may stop using the App at any time and request data deletion under the Privacy Policy.

13. Disclaimers

The App is provided “as is” and “as available” to the maximum extent permitted by law. We do not guarantee uninterrupted or error-free service or acceptance of any photo. Nothing here limits consumer rights that cannot legally be limited.

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect damages, lost data or opportunities, rejected applications, government delays, or third-party decisions. Total liability for a claim related to the App is limited to the greater of the amount you paid in the 12 months before the claim or PLN 100.

15. Your responsibility

To the extent permitted by law, you are responsible for claims arising from your photos, use of the App, violation of these Terms, law, or third-party rights.

16. Governing law and disputes

These Terms are governed by Polish law unless mandatory consumer law in your country requires otherwise. Before a formal dispute, please contact us so we can try to resolve the matter informally.

17. Changes to these Terms

We may update these Terms. For a material change, we will update the date and provide additional notice where required. Continued use after changes take effect means you accept the updated Terms.
